These Terms of Use govern your use of the Gamerang.com Web
site. By using, visiting, or browsing the Gamerang.com Web site, you accept and
agree to be bound by these Terms of Use. If you do not agree to these Terms of
Use, you should not use the Gamerang.com Web site. These Terms of Use are an
ongoing contract between you and Gamerang and apply to your use of the Gamerang
service and Web site. Please read these terms of use carefully as they affect
your rights.

Any information submitted on the Gamerang.com
Web site is subject to our Privacy Policy,
the terms of which are incorporated herein. Please review our Privacy Policy to
understand our practices.

You can find the specific details regarding your
subscription with Gamerang at anytime by clicking on the "Your Account" tab,
located at the top of the pages of the Gamerang.com Web site.
Special Offers
Special trials are only available to first time customers of the Gamerang
service and cannot be combined with any other offer. Only one special trial may
be redeemed per household. You must have Internet access and a valid credit
card to redeem a special trial offer. Upon registering for your special trial,
your credit card will be charged for the special offer and approximately one
month of service.
We encourage the use of our service through special offers. To view the
specific details regarding your special offers, if any, please click
here . Your special offer entitles you, during the term of your offer,
to the same service provided to our subscribers.
We will begin billing your credit card for monthly subscription fees for the
Gamerang Family Membership (currently
$14.95
) and any applicable sales tax. Click here to view the
end date of your special offer period. YOU MUST CANCEL PRIOR TO THE END OF YOUR
SPECIAL TRIAL OFFER TO AVOID ANY ADDITIONAL MONTHLY CHARGES TO YOUR CREDIT
CARD. You will not receive a notice from us that your trial membership has
ended or that your regular membership has begun. We will continue to bill your
credit card on a monthly basis for the Gamerang Standard Program until you
cancel. The Gamerang Budget Program is a month-to-month subscription that
allows subscribers to rent as many video games as they want in the month, with
up to two titles out at a time, with no late fees or due dates. Such a
subscription is cancelable at anytime. Click the "Your Account" button for
cancellation instructions. We offer a number of membership plans with different
number of games rentable at a time. We reserve the right to modify, terminate
or otherwise amend our offered membership plans. Unless otherwise stated
differently, month or monthly refers to your billing cycle (See "Billing"
below).
Billing
As a subscriber to Gamerang, you agree that we are permitted to charge your
credit card a monthly subscription fee, any applicable sales tax and any other
charges you may incur in connection with your use of Gamerang. The subscription
fee will be billed at the beginning of your subscription and on each monthly
renewal thereafter unless and until you cancel. Click here
to see the commencement date for your next renewal period. We will
automatically charge your credit card each month on the calendar day
corresponding to the commencement of your membership. Click
here to see the commencement date of your membership with Gamerang. In
the event your membership began on a day not contained in a given month, we
will bill your credit card on the last day of such month. For example, if you
became a member on July 31st, your card would be billed on August 31st. All
fees and charges are nonrefundable. We may change the fees and charges in
effect, or add new fees and charges from time to time, but we will give you
advance notice of these changes by email. If you want to use a different credit
card or if there is a change in your credit card validity or expiration date,
you may edit your credit card information by clicking on the "Your Account"
button, available at the top of the pages of the Gamerang.com Web site.
Automatic Renewals
Your Gamerang subscription will be automatically renewed on a monthly basis.
For your convenience, we will charge the monthly subscription fee to the credit
card you provide to us during registration (or to a different credit card if
you change your account information). Your membership will automatically renew
for successive monthly subscriptions, without prior notice to you, unless and
until you cancel your membership or we terminate it. You must cancel your
membership before it renews in order to avoid billing of subscription fees to
your credit card. Click on the "Your Account" link to see the commencement date
for your next renewal period. We will automatically bill your credit card each
month on the calendar day corresponding to the commencement of your membership.
In the event your membership began on a day not contained in a given month, we
will bill your Payment Method on the last day of such month. For example, if
you became a paying member on October 31st, your Payment Method would next be
billed on November 30th. All fees and charges are nonrefundable. We may change
the fees and charges in effect, or add new fees and charges from time to time,
but we will give you advance notice of these changes by e mail. If there is a
change in your credit card validity or expiration date, you may edit your
credit card information by clicking on the "Your Account" button, available at
the top of the pages of the Gamerang Web site. If your credit card reaches its
expiration date, your continued use of the service constitutes your
authorization for us to continue billing that credit card.
Delivery and Return of Rented Video Games
We use the U.S. Postal Service, first-class postage prepaid, to delivery and
return the disks you have selected to rent. Actual delivery times may vary for
you depending on (i) our inventory availability, (ii) your delivery address,
(iii) when you place your order and (iv) circumstances impacting delivery by
the U.S. Postal Service. We will send you an e-mail letting you know when we
have shipped your disk and the anticipated time of delivery. We use USPS
Delivery Confirmation on all outgoing mailers. A game is deemed delivered and
in your possession if the USPS Track & Confirm status shows that the mailer
was delivered.
Cancellation
As noted above, you may cancel your subscription to Gamerang at anytime. To
cancel, click the "Your Account" tab and follow the instructions under the
heading "Cancel Your Gamerang Membership." We do not provide refunds or credits
for any partial monthly subscription periods. Upon cancellation, you will be
given seven (7) days to return any outstanding rentals. Failure to return such
rentals will result in your credit card being billed for such items.

In order to provide you with ease of access to
your account, Gamerang, Inc. will place a cookie (a small text file) on any
computer from which you access the Gamerang.com Web site. When you revisit the
Gamerang.com web site, this cookie will enable us to recognize you as the
account holder and provide you with direct access to your account without
requiring you to retype any password or other user identification. You are
responsible for maintaining the confidentiality of your account and password
and for restricting access to your computer.

logos, designs, photographs, button icons, images, audio/video clips, digital
downloads, data compilations, and software, is the property of Gamerang, Inc.

Gamerang, Inc. and protected by U.S. and international copyright laws. They
should not be reproduced or used without express written permission from

trademarks of Gamerang, Inc. All Gamerang.com graphics, logos, page headers,
button icons, scripts and service names are trademarks or trade dress of
Gamerang, Inc. Gamerang's trademarks and trade dress may not be used in
connection with any product or service that is not Gamerang's, in any manner
that is likely to cause confusion among customers, or in any manner that
disparages or discredits Gamerang. All other trademarks not owned by Gamerang
that appear on the Gamerang.com Web site are the property of their respective
owners, who may or may not be affiliated with, connected to, or sponsored by
Gamerang. Any images of persons or personalities contained on the Gamerang.com
Web site shall not be an indication of endorsement of any particular product or
our service unless otherwise specifically indicated.

Visitors may post reviews, comments, and other content; send
e-cards and other communications; and submit suggestions, ideas, comments,
questions, or other information, so long as the content is not illegal,
obscene, threatening, defamatory, invasive of privacy, infringing of
intellectual property rights, or otherwise injurious to third parties or
objectionable and does not consist of or contain software viruses, political
campaigning, commercial solicitation, chain letters, mass mailings, or any form
of "spam." You may not use a false e-mail address, impersonate any person or
entity, or otherwise mislead as to the origin of a card or other content.
Gamerang.com reserves the right (but not the obligation) to remove or edit such
content, but does not regularly review posted content.
If you do post content or submit material, and unless we indicate otherwise,
you grant Gamerang.com and its affiliates a nonexclusive, royalty-free,
perpetual, irrevocable, and fully sublicensable right to use, reproduce,
modify, adapt, publish, translate, create derivative works from, distribute,
and display such content throughout the world in any media. You grant
