Wii Balance Board patent lawsuit falls flat

Nintendo has prevailed again in another patent infringement lawsuit, this time concerning the Wii Balance Board. The U.S. District Court of Maryland has ruled in Nintendo's favor, dictating that the Balance Board and Wii Fit by proxy did not in fact encroach on a patent held by IA Labs, marking their third consecutive court victory this year. Nintendo issued a fairly terse press release earlier today, announcing that it has prevailed in a US patent lawsuit for the "third consecutive time this year." That particular case concerned Nintendo's Wii Balance Board accessory and Wii Fit and Wii Fit Plus software, which a company called IA Labs said infringed on one of its patents (No. 7,121,982) (more)

Etrian Odyssey IV coming to the 3DS in Japan, classes detailed

Atlus has officially confirmed that Etrian Odyssey IV is on its way to the Nintendo 3DS in Japan later this year. The fourth in the series of popular RPGs (Etrian Odyssey 3 arrived in North America last year) will have an easier casual difficulty setting, and will boast seven different classes, including Rune Masters, Medics, Snipers, Swordsmen, Fortress units, and Dancers. Pokemon Black and White 2 has just been announced on Pokemon Smash, an official Pokemon television program in Japan. The sequel to Pokemon Black and White will launch for the DS in Japan this June. No further specifics are yet available regarding North American availability, new Pokemon or any battle-system changes that may occur. (more)

It makes sense. More individuals are streaming Netflix on their consoles and, as of last summer, the Wii was used to stream Netflix most often. According to a report on AdWeek, Nintendo is working out deals with major content providers right now for the Wii's successor, the Wii U. (more)

Other than some standard info on a few mini-games that will be appearing in the game, we get some cold, hard facts on the actual gameplay, and some insight into how the series will be changing quite a bit for 9. Call us masochists, but we were really looking forward to the stateside release of Japanese horror title Nanashi no Game, or its sequel, Nanashi no Game Me (trailer above) for the DS. Neither of these made the trip -- evil spirits are afraid of flying, we assume -- and now there is one more Nanashi no Game title we can feel left out on, Nanashi no Appli, out today for iOS devices in Japan. Nintendo releases quarterly earnings report: 61 percent drop in profit, grim forecast

Nintendo released its latest quarterly earnings report this morning and, as with last quarter's report, there's not a whole lot to celebrate. The company posted profits of ¥40.9 billion (about $631.6 million) for the October - December period, representing a 61 percent quarterly drop. That's especially disappointing, considering that this period has traditionally been strong for Nintendo, which had previously forecast an operating profit of ¥1 billion (around $12.9 million). Kotaku has learned from an unnamed source that Microsoft's next console will feature a Blu-ray optical drive and some kind of anti-used game system. Details surrounding this little interesting nugget is virtually nonexistent -- even the source wasn't sure how Microsoft planned to implement such a system. (more)

Gaikai is set to launch full-game streaming services on its network of gaming and entertainment websites, ramping up its current demo-only model, GamesIndustry reports. Hudson name will live on after Konami takeover

We're still not sure if Konami will take the Hudson bee out back and put two tiny bullets into its brain, Old Yeller style, but Konami at least plans to keep the Hudson name around. According to a notice spotted on the company's site by Andriasang, Hudson branded products and services will continue to be developed post-acquisition. (more)

The top two spots in Japan's 2011 list of best-selling games are taken by a pair of Nintendo 3DS games: Mario Kart 7, with more than 1.6 million sold, and Super Mario 3D Land with more than 1.08 million sold. In third is Capcom's Monster Hunter Tri-G for 3DS, followed by 27 more titles for 3DS, DS PSP, Wii and PS3. These include From Software's Dark Souls and Square Enix's Final Fantasy XIII-2. (more)
